Terms of Service

These terms are an agreement between Fugitive Labs, LLC, doing business as Samplify Pro (“Samplify,” “we”), and the business that opens a Samplify account (“you,” “your store”). By creating an account or using the service, you’re agreeing to them on behalf of your store, and you’re confirming you have the authority to do that.

What Samplify is

Samplify tracks the samples your store sends home with customers. Reps photograph sample labels at checkout, Samplify creates the record, texts the customer follow-ups from your store’s dedicated number, and shows your store the resulting pipeline. It’s a tool for your business, not a consumer product.

Your account

Owners can invite reps and other team members. Every person needs their own login, and your store is responsible for what happens under its accounts, so keep passwords private and remove people who leave. Tell us at support@samplifypro.com if you think an account has been compromised.

Billing

Samplify is a monthly subscription per store, billed through Stripe at the price shown when you sign up. Subscriptions renew automatically each month until you cancel. You can cancel any time; cancellation takes effect at the end of the current billing period, and we don’t refund partial months. Prices can change, but never mid-cycle and never without at least 30 days’ notice. You’re responsible for any applicable taxes.

Your customers’ data

The records your store creates in Samplify — customer names, phone numbers, orders, messages, label photos — belong to your store. You give us permission to store and process them only as needed to run the service, as described in our Privacy Policy. In return, you promise that your store has the right to enter that information and to have Samplify contact those customers.

Texting rules

This section matters more than any other. Samplify sends real text messages to real people from a number registered to your store, and the law (the TCPA, among others) puts the duty of consent on you.

• Only enter customers who gave your store consent to be texted. The checkout opt-in exists for exactly this.
• Never load purchased lists or contacts who haven’t done business with your store.
• When a customer replies STOP, messaging to them stops automatically and you must not re-add them unless they opt back in.
• Samplify sends automated messages only between 9:00 a.m. and 8:00 p.m. in your store’s local time. Don’t use manual messaging to get around that.

If your store’s messaging draws spam complaints, carrier violations, or legal claims, that’s on your store, and repeated abuse is grounds for us to suspend messaging or the account.

Acceptable use

Don’t use Samplify to break the law, harass anyone, or send messages unrelated to your store’s business with the customer. Don’t probe, overload, or interfere with the service, and don’t resell access to it.

Accuracy of the AI scan

Label scanning uses AI to read manufacturer, style, and SKU from a photo. It’s right most of the time and it can be wrong. Review what it logs; don’t treat a scan as a source of truth for pricing or ordering material.

Ownership

Your store owns its data. We own Samplify — the software, design, and everything that makes it run. Neither of us gets rights to the other’s property beyond what these terms grant.

Availability and changes

We work to keep Samplify up and improving, and we’ll keep changing it: we may add, adjust, or retire features. We don’t promise uninterrupted service.

Disclaimers and limits on liability

Samplify is provided “as is,” without warranties of any kind. To the fullest extent the law allows, our total liability for any claim related to the service is capped at the amount your store paid us in the 12 months before the claim, and neither of us is liable to the other for indirect damages such as lost profits. Nothing here limits liability the law says can’t be limited.

If your store’s use causes a claim

If a third party brings a claim against us because your store broke the texting rules above or entered data it had no right to enter, your store will cover the costs and damages of that claim.

Ending the agreement

You can close your account whenever you like. We can suspend or close accounts that violate these terms, and we’ll say why. When an account closes, you get a window to export your customer records, after which we delete them as described in the Privacy Policy, and your store’s texting number is released.

Governing law

These terms are governed by the laws of the State of North Carolina, and disputes will be resolved in the courts of North Carolina.

Changes to these terms

When we change these terms in a way that matters, we’ll email account owners at least 30 days before the change takes effect. Continuing to use Samplify after that date means the new terms apply.
